Stop Creditor Harassment by Taking Action Today
The national Fair Debt Collection Practices Act (FDCPA) regulates the actions of creditors and debt collectors. It specifically cites actions debt collectors can and cannot take when calling debtors. For example, debt collectors cannot call a consumer:
- At a time when the collector knows would be inconvenient for the consumer
- Before 8 a.m. or after 9 p.m.
- If the collector knows the consumer is represented by an attorney
In addition, debt collectors cannot call anyone but the consumer or the consumer's lawyer to attempt to collect on an unpaid debt. A debt collector is also forbidden from:
- Threatening the use of violence, or using violence, to collect on a debt
- Using profanity or other obscene language as a means to harass the consumer
- Repeatedly or continuously calling any person as a means to harass that person
If you are receiving debt collections phone calls that violate the FDCPA in any of the means listed above, reach out to an experienced bankruptcy lawyer at our firm. We can help you end the collection calls and pursue any legal remedies that may be available to you.
